TERMS OF SERVICE

1. Introduction

Welcome to Web Boomers.

These Terms of Service ("Terms") govern your access to and use of services provided by Web Boomers, including web hosting, domain registration and related services, website development, software and SaaS products, graphic and digital services, maintenance, technical support, and other services offered through our websites and platforms.

By creating an account, purchasing a service, placing an order, or using any service provided by Web Boomers, you acknowledge that you have read, understood, and agreed to these Terms.

If you do not agree with these Terms, please do not use our services.

Web Boomers may provide services directly or through third-party service providers, infrastructure providers, payment processors, registrars, APIs, software providers, and other technology partners.

3. Eligibility

You must provide accurate and complete information when creating an account or purchasing a service.

You must have the legal capacity to enter into an agreement under applicable law.

If you are purchasing a service on behalf of an organization, you confirm that you have authority to act on behalf of that organization.

4. Account Registration

Certain services require you to create an account.

You are responsible for:

  • Providing accurate information.
  • Keeping your account information up to date.
  • Maintaining the confidentiality of your password and login credentials.
  • Maintaining the security of your account.
  • All activities performed through your account.

You must immediately notify Web Boomers if you believe your account has been compromised or accessed without authorization.

Web Boomers may suspend or restrict an account where we reasonably believe there is unauthorized access, fraudulent activity, abuse, or a violation of these Terms.

5. Services

Web Boomers may provide, among other things:

  • Web hosting
  • Domain-related services
  • Business email and email hosting
  • Website development
  • Website maintenance
  • Graphic and digital design
  • Custom software development
  • SaaS and subscription-based software
  • Gym management software, including GymOS
  • Billing and business management software, including Bill Pro
  • Technical support
  • Website security and maintenance
  • Other digital products and services

Service availability, features, specifications, pricing, and limitations may vary depending on the selected product or plan.

6. Orders and Service Activation

Placing an order does not necessarily mean that a service has been activated.

Web Boomers may review an order before activation.

We reserve the right to:

  • Accept or reject an order.
  • Request additional information.
  • Cancel an order where necessary.
  • Suspend activation where payment or verification is incomplete.
  • Correct pricing or product errors.

A service becomes active when Web Boomers confirms activation or makes the purchased service available to the customer.

7. Payments

Unless otherwise stated, services must be paid for according to the pricing and payment terms displayed at the time of purchase.

You agree to provide accurate billing information.

Web Boomers may use third-party payment providers to process payments. We do not generally store complete card, UPI, banking, or other sensitive payment credentials on our own systems when payment processing is handled by a third-party provider.

Failure to make a required payment may result in:

  • Service suspension.
  • Limited access.
  • Late payment restrictions.
  • Termination of the affected service.

8. Taxes

Prices may be displayed inclusive or exclusive of applicable taxes depending on the service and billing configuration.

You are responsible for applicable taxes associated with your purchase unless otherwise stated.

Where required, Web Boomers may collect and report applicable taxes in accordance with applicable law.

9. Subscriptions and Renewals

Certain services are provided on a recurring subscription basis.

Recurring services may require renewal payments to remain active.

You are responsible for ensuring that your billing information is valid and that renewal payments can be processed.

If renewal payment is not received, Web Boomers may suspend or terminate the service after applicable notices or grace periods.

10. Domain Services

Domain registrations and renewals may be subject to the policies, rules, and terms of the applicable domain registry or registrar.

Web Boomers does not guarantee that a requested domain name will be available.

Once a domain registration has been successfully submitted or completed, cancellation or refund may be restricted depending on the applicable registry, registrar, and service terms.

You are responsible for providing accurate domain registration information and keeping it updated.

11. Web Hosting

Hosting services are subject to the limitations of the selected hosting plan.

You must not use Web Boomers hosting services for activities that are illegal, abusive, fraudulent, malicious, or that negatively affect our infrastructure or other customers.

Prohibited activities may include:

  • Malware distribution.
  • Phishing.
  • Fraudulent websites.
  • Unlawful content.
  • Unauthorized access attempts.
  • Cryptocurrency mining without written authorization.
  • Spam or abusive email activity.
  • Distribution of malicious software.
  • Activities designed to disrupt servers or networks.
  • Excessive resource usage that negatively affects other customers.

Web Boomers may suspend a hosting account when necessary to protect our infrastructure, customers, or network.

12. Email Services

If Web Boomers provides email hosting, you are responsible for using the service lawfully.

You must not use our email infrastructure for:

  • Spam.
  • Phishing.
  • Fraud.
  • Malware distribution.
  • Harassment.
  • Bulk unsolicited messaging.
  • Forged sender identities.
  • Other prohibited or unlawful activities.

Email delivery is dependent on external networks and receiving mail servers. Web Boomers cannot guarantee delivery of every email message.

13. Website Development

For website development projects, the project scope, features, pricing, delivery timeline, and revisions may be defined in the relevant quotation, proposal, invoice, or project agreement.

Additional work outside the agreed scope may require additional charges.

Client delays in providing:

  • Content
  • Images
  • Branding materials
  • Credentials
  • Approvals
  • Technical information

may affect the project delivery timeline.

Unless otherwise agreed, final ownership or transfer of deliverables may be subject to full payment.

14. Custom Software Development

Custom software projects may involve separate development agreements or project specifications.

Unless explicitly agreed otherwise, Web Boomers does not guarantee that custom software will:

  • Remain compatible with every future operating system or third-party service.
  • Remain compatible with changes made by external APIs.
  • Be completely free of bugs.
  • Meet requirements that were not included in the agreed project scope.

Maintenance, hosting, updates, third-party API changes, and additional functionality may be charged separately.

15. SaaS and Software Products

Web Boomers may provide software products such as GymOS and Bill Pro as subscription-based or licensed services.

Software features may change over time due to security updates, improvements, maintenance, or technical requirements.

Unless specifically stated otherwise, purchasing a subscription provides access to the software during the applicable subscription period and does not transfer ownership of the underlying software, source code, or intellectual property.

16. GymOS

GymOS is a gym management software product intended to assist businesses with gym and membership management.

The customer remains responsible for:

  • Member information.
  • Financial records.
  • Membership information.
  • Staff access.
  • Data entered into the system.
  • Compliance with applicable laws.

Web Boomers does not guarantee that software will prevent every business, financial, operational, or data-related error.

17. Bill Pro

Bill Pro is a business billing/invoicing software product.

The customer is responsible for verifying:

  • Invoice information.
  • Customer information.
  • Tax information.
  • Prices.
  • Payment records.
  • Financial reports.

Software-generated calculations and documents should be reviewed by the customer before being used for legal, tax, accounting, or regulatory purposes.

18. Backups and Data

Where backups are provided, they are intended as a recovery measure and should not be considered a substitute for maintaining your own independent backups.

You are responsible for maintaining appropriate copies of important business data.

Web Boomers will take reasonable measures to maintain service infrastructure but cannot guarantee that data will never be lost, corrupted, damaged, or unavailable.

19. Acceptable Use

You agree not to use Web Boomers services to:

  • Break applicable laws.
  • Infringe intellectual property rights.
  • Distribute malware.
  • Conduct phishing or fraud.
  • Attack or compromise computer systems.
  • Host prohibited content.
  • Send unsolicited spam.
  • Attempt unauthorized access.
  • Abuse system resources.
  • Interfere with other users.
  • Circumvent security controls.
  • Engage in activities that could damage our infrastructure or reputation.

20. Suspension and Termination

Web Boomers may suspend or terminate services where reasonably necessary due to:

  • Non-payment.
  • Abuse.
  • Fraud.
  • Security threats.
  • Illegal activity.
  • Violation of these Terms.
  • Requests from competent authorities.
  • Activities that threaten our infrastructure or other users.

Where reasonably possible, we may provide notice before suspension or termination.

21. Refunds and Cancellations

Refund eligibility depends on the specific product or service purchased.

Because certain services involve third-party costs, infrastructure allocation, domain registration, payment processing, development work, or immediate service delivery, some purchases may be non-refundable.

Any specific refund policy displayed during checkout, included in an order, quotation, invoice, or service agreement will apply to that transaction.

Where no specific refund policy applies, Web Boomers may evaluate refund requests on a case-by-case basis.

22. Third-Party Services

Web Boomers may integrate with third-party services including:

  • Payment gateways.
  • Domain registrars.
  • Hosting infrastructure providers.
  • Cloud platforms.
  • Email providers.
  • APIs.
  • Analytics services.
  • Security services.

Third-party services are subject to their respective terms and policies.

Web Boomers is not responsible for outages, policy changes, pricing changes, or failures caused by third-party providers.

23. Intellectual Property

Unless otherwise agreed:

  • Web Boomers retains ownership of its software, systems, branding, source code, templates, tools, frameworks, and proprietary materials.
  • Customers retain ownership of content and materials they provide, subject to the rights necessary for us to provide the service.
  • You must not copy, resell, reverse engineer, modify, redistribute, or commercially exploit Web Boomers proprietary software without written permission.

24. Customer Content

You are responsible for ensuring that content uploaded or provided to Web Boomers does not violate applicable laws or third-party rights.

You represent that you have the necessary rights and permissions to use content supplied to us.

25. Service Availability

We aim to provide reliable services, but uninterrupted availability cannot be guaranteed.

Services may occasionally be affected by:

  • Scheduled maintenance.
  • Emergency maintenance.
  • Hardware failure.
  • Network issues.
  • Data-center problems.
  • Third-party outages.
  • Cybersecurity incidents.
  • Force majeure events.

We may perform maintenance when reasonably necessary.

26. Limitation of Liability

To the maximum extent permitted by applicable law, Web Boomers shall not be liable for indirect, incidental, special, consequential, or business losses arising from the use or inability to use our services.

This may include loss of:

  • Revenue.
  • Business opportunities.
  • Data.
  • Reputation.
  • Profits.
  • Expected savings.

Nothing in these Terms is intended to exclude liability that cannot legally be excluded under applicable law.

27. Indemnification

You agree to indemnify and hold Web Boomers harmless from claims, damages, losses, liabilities, and expenses arising from your misuse of our services, violation of these Terms, unlawful activity, or infringement of third-party rights.

28. Changes to Services

Web Boomers may modify, improve, discontinue, or replace features or services when reasonably necessary.

Where a material change affects an active paid service, we may provide reasonable notice where appropriate.

29. Changes to These Terms

We may update these Terms from time to time.

The updated version will become effective when published unless another effective date is specified.

Continued use of our services after an update constitutes acceptance of the updated Terms, to the extent permitted by applicable law.

30. Governing Law

These Terms shall be governed by the applicable laws of India.

Subject to applicable law, disputes shall be subject to the jurisdiction of the appropriate courts having jurisdiction over Web Boomers' applicable place of business.
